Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://www.quiztheclass.com (the "Service"), operated by Gargasz Interactive LLC ("we," "us," or "our") under the brand QuizTheClass. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

If your use of the Service is governed by a Student Data Privacy Agreement (SDPA or DPA) between us and your school district, the SDPA controls in the event of any conflict with these Terms regarding the treatment of student data.

1. The Service

QuizTheClass is a browser-based classroom response system. Teachers create quiz and poll sessions; students join using a short code on any web-connected device. The Service includes real-time question delivery, response collection, auto-grading, score release, and session history.

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify active subscribers of material changes in advance.

2. Accounts

2a. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a teacher account. Students do not create accounts; they participate under the direction of their teacher.

2b. Account security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at support@quiztheclass.com if you suspect unauthorized use of your account. We enforce single-session login: signing in from a new device will end any existing session.

2c. Accurate information

You agree to provide truthful, current information when creating your account and to keep it up to date.

3. Free trial & subscriptions

3a. Free trial

New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial. When the trial ends, you must subscribe to continue using the Service.

3b. Paid plans

We offer monthly ($8.99/month) and annual ($59.88/year) subscription plans. Prices may change; we will notify existing subscribers at least 30 days before a price increase takes effect on their next billing cycle.

3c. Billing

Subscriptions are billed in advance on a recurring basis through Stripe, Inc. By subscribing you authorize Stripe to charge your payment method at each renewal. You can view and manage your subscription from your account dashboard.

3d. Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until that date. We do not provide prorated refunds for partial billing periods.

3e. Refunds

Because the Service offers a free trial, refunds are generally not provided. If you believe you were charged in error, contact support@quiztheclass.com and we will review your case promptly.

5. Content & intellectual property

5a. Your content

You retain ownership of the questions, images, and other materials you upload to the Service ("Your Content"). By uploading content you grant us a limited, non-exclusive license to store, display, and transmit it solely for the purpose of providing the Service to you and your students.

5b. Student responses

Student answers and session data are associated with the teacher's account and are subject to the teacher's control (including deletion). If a Student Data Privacy Agreement is in place with your school district, that agreement governs ownership and disposition of student data.

5c. Our intellectual property

The Service — including its design, code, logos, and documentation — is owned by Gargasz Interactive LLC and protected by copyright and other intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without prior written consent.

6. Privacy

Our collection and use of personal information is described in our Privacy Policy. For school districts evaluating the Service, our Student Data & Privacy page provides additional detail on student data practices.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GARGASZ INTERACTIVE LLC, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Gargasz Interactive LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

You may close your account at any time by contacting support@quiztheclass.com. We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including sections 5c, 7, 8, 9, and 12) will survive.

11. Changes to these Terms

We may update these Terms from time to time. The "Effective date" at the top reflects the most recent revision. If we make material changes, we will notify you by email or a prominent notice on the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing law & disputes

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of such courts.
